The Nigeria Data Protection Commission (NDPC) has issued a stern warning to content creators, cautioning them against capturing and sharing pictures or video footage of members of the public without consent, as this violates citizens' privacy rights.
The regulatory body emphasized that such unauthorized capturing and sharing of images or videos of unsuspecting individuals violates fundamental privacy protections guaranteed under Section 37 of the 1999 Constitution of the Federal Republic of Nigeria and the Nigeria Data Protection Act, 2023 (NDP Act).
The alert comes amid growing concerns over a specific case involving a content creator in Lagos State who positions herself at roadsides to film members of the public as part of what is described as a "reality show." The NDPC's preliminary investigation found that this practice constitutes a willful invasion of citizens' privacy, serving neither a public interest nor any legitimate basis under data protection laws.
The NDPC warned that individuals engaging in such practices may face criminal prosecution for breaching the privacy rights of citizens and other data subjects in Nigeria. This move underscores the Commission's commitment to safeguarding informational self-determination in an era of widespread social media content creation.
